1. Agreement to Terms
By downloading, installing, accessing, or using Friendly App ("the App" or "the Service"), you agree to be bound by this End User License Agreement ("EULA" or "Agreement"). If you do not agree to these terms, do not download, install, access, or use the App.
Important: This Agreement is a legally binding contract between you and Friendly App ("we," "us," or "our"). Please read it carefully before using the App.
2. Description of Service
Friendly App is a secure messaging application designed for people who have met in person. The App provides:
- Secure Messaging: End-to-end encrypted messaging between friends
- Friend Discovery: Bluetooth-based friend discovery and key exchange
- Group Chats: Encrypted group messaging with up to 20 members
- Media Sharing: Encrypted photo and video sharing
- Zero-Trust Security: Personal encryption keys never leave your device
Key Features:
- Messages are encrypted end-to-end before transmission
- Personal encryption keys are exchanged via Bluetooth during in-person meetings
- The server cannot decrypt or read your messages
- You can revoke friendships and permanently delete all messages
3. License Grant and Restrictions
3.1 License Grant
Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to:
- Download and install the App on your personal mobile device(s)
- Use the App for personal, non-commercial purposes
- Access and use the Service in accordance with this Agreement
3.2 License Restrictions
You agree NOT to:
- Reverse Engineer: Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
- Modify: Modify, adapt, alter, or create derivative works of the App
- Remove Notices: Remove, alter, or obscure any copyright, trademark, or other proprietary notices
- Commercial Use: Use the App for any commercial purpose without our express written permission
- Resell: Sell, rent, lease, sublicense, or otherwise transfer the App or your account to any third party
- Circumvent Security: Attempt to circumvent, disable, or interfere with security features of the App
- Automated Access: Use bots, scripts, or automated systems to access the Service
- Interfere: Interfere with or disrupt the Service or servers connected to the Service
3.3 Intellectual Property
The App, including all content, features, functionality, and technology, is owned by Friendly App and protected by copyright, trademark, patent, and other intellectual property laws. This Agreement does not grant you any ownership rights in the App.
4. Eligibility and Age Requirements
4.1 Age Requirement
You must be at least 13 years of age to use Friendly App. If you are under 13, you are not permitted to use the App.
For Users 13-17: If you are between 13 and 17 years of age, you represent that you have obtained parental or guardian consent to use the App and that your parent or guardian has agreed to this EULA on your behalf.
4.2 Account Responsibility
You are responsible for:
- Maintaining the confidentiality of your device and account
- All activities that occur under your account
- Ensuring that anyone who uses your device to access the App complies with this Agreement
5. User Obligations and Acceptable Use
5.1 Acceptable Use
You agree to use Friendly App only for lawful purposes and in accordance with this Agreement. You agree NOT to use the App to:
- Illegal Activities: Violate any applicable laws, regulations, or third-party rights
- Harmful Content: Transmit, upload, or share content that is:
- Illegal, harmful, threatening, abusive, harassing, defamatory, or invasive of privacy
- Obscene, pornographic, or sexually explicit
- Discriminatory, hateful, or promotes violence
- Infringes intellectual property rights
- Contains viruses, malware, or other harmful code
- Spam: Send unsolicited messages, spam, or bulk communications
- Impersonation: Impersonate any person or entity or falsely claim affiliation with any person or entity
- Harassment: Harass, abuse, or harm other users
- Fraud: Engage in fraud, phishing, or other deceptive practices
- Unauthorized Access: Attempt to gain unauthorized access to accounts, systems, or networks
- Interference: Interfere with or disrupt the Service or other users' use of the Service
5.2 Friend-Focused Design
Friendly App is designed for people who have met in person. You agree:
- In-Person Key Exchange: To exchange encryption keys only with people you have met in person
- No Strangers: Not to attempt to add strangers or people you have not met
- Bluetooth Requirement: To use Bluetooth for key exchange only during in-person meetings
- Real-World Connections: To use the App only for communication with real-world acquaintances
5.3 Content Responsibility
You are solely responsible for:
- All content you send, upload, or share through the App
- Ensuring you have the right to share any content you transmit
- The consequences of sharing content, including any legal liability
We do not monitor, review, or moderate user content. However, we reserve the right to:
- Remove or block content that violates this Agreement
- Suspend or terminate accounts that violate this Agreement
- Report illegal content to law enforcement
6. Privacy and Data Protection
6.1 Privacy Policy
Your use of Friendly App is also governed by our Privacy Policy, which is incorporated into this Agreement by reference. By using the App, you consent to the collection, use, and sharing of your information as described in the Privacy Policy.
Key Privacy Principles:
- We implement a zero-trust security model
- Your personal encryption keys never leave your device
- We cannot decrypt or read your messages
- We collect minimal data necessary for service operation
- We do not sell your data to third parties
6.2 Data Control
You have control over your data:
- You can delete individual messages or entire conversations
- You can revoke friendships and permanently delete all messages
- You can delete your account and all associated data
- Messages stored on friends' devices remain under their control
6.3 Data Location
Your data is processed and stored on servers located in Knoxville, Tennessee, United States. By using the App, you consent to the transfer of your data to the United States in accordance with our Privacy Policy.
7. Encryption and Security
7.1 Zero-Trust Security Model
Friendly App implements a zero-trust security model:
- Personal Keys: Your personal encryption keys (RSA-2048) are generated on your device and never transmitted to our servers
- End-to-End Encryption: Messages are encrypted on your device before transmission
- Server Cannot Decrypt: We cannot decrypt or read your messages, even if we wanted to
- Bluetooth Key Exchange: Encryption keys are exchanged via Bluetooth during in-person meetings
7.2 Your Security Responsibilities
You are responsible for:
- Device Security: Keeping your device secure and protected
- Key Protection: Not sharing your encryption keys with anyone
- Bluetooth Security: Using Bluetooth key exchange only in secure, private locations
- Account Security: Not sharing your device or account with unauthorized persons
7.3 Security Limitations
While we implement industry-standard security measures:
- No Guarantee: We cannot guarantee absolute security
- Your Responsibility: You are responsible for maintaining device security
- Third-Party Risks: We are not responsible for security breaches caused by third parties (e.g., device manufacturers, operating systems)
8. Service Availability and Modifications
8.1 Service Availability
We strive to provide reliable service but do not guarantee:
- Uptime: Continuous, uninterrupted, or error-free operation
- Availability: That the Service will be available at all times
- Performance: Specific performance levels or response times
The Service may be unavailable due to:
- Maintenance, updates, or technical issues
- Force majeure events (natural disasters, war, etc.)
- Third-party service outages (e.g., Firebase, hosting providers)
8.2 Service Modifications
We reserve the right to:
- Modify Features: Add, remove, or modify features at any time
- Discontinue: Discontinue the Service or any part of it with reasonable notice
- Updates: Release updates that may require you to update the App
- Beta Features: Offer beta features that may be modified or discontinued
8.3 Updates
You agree to:
- Install Updates: Install updates to the App when available
- Compatibility: Ensure your device is compatible with updated versions
- Data Loss: Acknowledge that updates may affect app functionality or data
9. Third-Party Services
9.1 Firebase Cloud Messaging
Friendly App uses Google Firebase Cloud Messaging (FCM) for push notifications. By using the App, you agree to:
- Google's Terms: Google's Terms of Service and Privacy Policy apply to FCM
- Data Processing: FCM processes data in the United States
- Third-Party Service: We are not responsible for FCM service availability or issues

9.2 Other Third-Party Services
We do not use other third-party services for:
- Analytics or tracking
- Advertising
- User behavior monitoring
10. Disclaimers
10.1 Service "As Is"
THE APP AND SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Merchantability: Implied warranties of merchantability
- Fitness for Purpose: Warranties of fitness for a particular purpose
- Non-Infringement: Warranties of non-infringement
- Accuracy: Warranties regarding accuracy, reliability, or completeness
10.2 Specific Disclaimers
We do not warrant that:
- The App will meet your requirements or expectations
- The Service will be uninterrupted, timely, secure, or error-free
- Any errors or defects will be corrected
- The App is free of viruses or other harmful components
- The results obtained from using the App will be accurate or reliable
10.3 Content Disclaimers
We are not responsible for:
- User Content: The content, accuracy, or legality of user-generated content
- Third-Party Content: Content shared by other users
- Message Delivery: Guaranteed delivery of messages (though we strive for reliable delivery)
- Data Loss: Loss of data due to device issues, app uninstallation, or other causes
11. Limitation of Liability
11.1 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FRIENDLY APP, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR:
- Indirect Damages: Any indirect, incidental, special, consequential, or punitive damages
- Lost Profits: Loss of profits, revenue, data, or business opportunities
- Personal Injury: Personal injury or property damage
- Total Liability: Any damages exceeding the amount you paid to us (if any) in the 12 months preceding the claim
11.2 Exclusions
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the maximum extent permitted by law.
11.3 Force Majeure
We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including:
- Natural disasters, war, terrorism, or acts of God
- Internet or telecommunications failures
- Government actions or regulations
- Third-party service outages
12. Indemnification
You agree to indemnify, defend, and hold harmless Friendly App, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use of the App or Service
- Your violation of this Agreement
- Your violation of any law or third-party rights
- Your content or conduct
- Your negligence or willful misconduct
13. Termination
13.1 Termination by You
You may terminate this Agreement at any time by:
- Uninstalling: Uninstalling the App from your device
- Account Deletion: Requesting account deletion by contacting friendly@friendlyapp.net
Upon termination:
- Your license to use the App will immediately cease
- You must stop using the App
- We will delete your account and associated data (as described in the Privacy Policy)
- Messages stored on friends' devices will remain on their devices
13.2 Termination by Us
We may terminate or suspend your access to the App at any time, with or without cause or notice, if you:
- Violate this Agreement
- Engage in illegal or harmful activities
- Abuse the Service or other users
- Fail to pay any fees (if applicable in the future)
Upon termination by us:
- Your license to use the App will immediately cease
- We may delete your account and associated data
- You must stop using the App
13.3 Effect of Termination
Upon termination:
- All rights granted to you under this Agreement will immediately cease
- You must delete all copies of the App from your devices
- Sections of this Agreement that by their nature should survive termination will survive (including Sections 6, 10, 11, 12, and 15)
14. Beta Program
14.1 Beta Participation
If you participate in the beta testing program:
- Beta Features: You may have access to beta features that are not publicly available
- Testing Purpose: The beta version is for testing purposes only
- No Warranty: Beta features are provided "as is" without warranty
- Modifications: Beta features may be modified or discontinued at any time
14.2 Beta Feedback
We encourage beta users to provide feedback. By providing feedback, you grant us the right to use, modify, and incorporate your feedback into the App without compensation.
14.3 Beta Termination
We may terminate your beta access at any time, with or without notice.
15. Dispute Resolution and Governing Law
15.1 Governing Law
This Agreement is governed by and construed in accordance with the laws of the State of Tennessee, United States, without regard to its conflict of law provisions.
15.2 Dispute Resolution
For Users in the United States:
- Any disputes arising out of or relating to this Agreement will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association
- Arbitration will be conducted in Knoxville, Tennessee
- You waive your right to a jury trial and to participate in class actions
For Users Outside the United States:
- Disputes will be resolved in accordance with applicable local laws
- You may have additional rights under local consumer protection laws
15.3 Class Action Waiver
You agree that any disputes will be resolved individually and not as part of a class action, consolidated action, or representative proceeding.
16. General Provisions
16.1 Entire Agreement
This Agreement, together with the Privacy Policy, constitutes the entire agreement between you and Friendly App regarding the App and Service and supersedes all prior agreements and understandings.
16.2 Modifications
We reserve the right to modify this Agreement at any time. We will notify you of material changes by:
- Posting the updated Agreement in the App
- Updating the "Last Updated" date
- Sending a notification through the App (for significant changes)
Your continued use of the App after changes become effective constitutes acceptance of the updated Agreement. If you do not agree to the changes, you must stop using the App and delete your account.
16.3 Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
16.4 Waiver
Our failure to enforce any provision of this Agreement does not constitute a waiver of that provision or any other provision.
16.5 Assignment
You may not assign or transfer this Agreement or your rights under it without our prior written consent. We may assign or transfer this Agreement without restriction.
16.6 Notices
Notices to you may be sent:
- Through the App
- To the email address associated with your account (if applicable)
- By posting in the App

16.7 Export Restrictions
You agree to comply with all applicable export and import laws and regulations. The App may be subject to export restrictions, and you are responsible for compliance with all applicable laws.
16.8 Government Users
If you are a U.S. government user, the App is provided with "RESTRICTED RIGHTS" as defined in applicable regulations.

18. Acknowledgment
By downloading, installing, accessing, or using Friendly App, you acknowledge that:
- You have read and understood this Agreement
- You agree to be bound by its terms
- You are at least 13 years of age (or have parental consent)
- You will use the App only for lawful purposes
- You understand the zero-trust security model and encryption features
- You consent to data processing as described in the Privacy Policy
19. Special Provisions for EU Users
19.1 Consumer Rights
If you are a consumer in the European Union, you have certain rights that cannot be excluded by this Agreement, including:
- Right to withdraw from the contract within 14 days (if applicable)
- Right to receive clear and transparent information
- Right to access, rectify, and delete your personal data
19.2 Mandatory Consumer Law
Nothing in this Agreement affects your mandatory rights under applicable consumer protection laws in your jurisdiction.
19.3 Dispute Resolution (EU)
If you are in the EU, you may have the right to:
- File a complaint with your local data protection authority
- Seek remedies through your local courts
- Participate in alternative dispute resolution procedures
20. Special Provisions for California Users
20.1 California Consumer Rights
If you are a California resident, you have certain rights under the California Consumer Privacy Act (CCPA), including:
- Right to know what personal information is collected
- Right to delete personal information
- Right to opt-out of the sale of personal information (we do not sell data)
20.2 "Shine the Light" Law
California Civil Code Section 1798.83 permits California residents to request information about how we share certain categories of personal information with third parties. We do not share personal information with third parties for their direct marketing purposes.
